WHAT IS A TRADEMARK?

A trademark is any distinctive sign — a name, logo, tagline, colour combination, shape, or even a sound — that identifies your goods or services and sets them apart from competitors. Once registered under the Trade Marks Act, 1999, it becomes your exclusive legal property across India.

The ™ symbol can be used immediately after filing. The ® symbol is only permitted after registration is granted — typically 18–24 months after filing.

Why Registration Matters

Registering a trademark safeguards your unique business identity, grants exclusive legal rights to your name and logo, and stops unauthorized competitors from using your brand. It builds long-term consumer trust, protects your market reputation, and gives you the legal authority to take action against infringement. Ultimately, it turns your brand into a secure, valuable corporate asset that adds equity to your company and ensures sustainable growth without the risk of costly rebranding disputes down the road.

1. Exclusive legal ownership

Once registered, you have the exclusive right to use that mark across India in your category. No competitor can legally use a similar mark for the same class of goods or services.

2. Legal protection against infringement

Registration gives you the right to sue for damages and injunctions if someone copies your brand. Without registration, enforcement is significantly harder and more expensive.

3. Business asset with real value

A registered trademark can be licensed, franchised, or sold. It adds tangible value to your business during investment or acquisition due diligence.

4. Build customer trust

The ® symbol signals legitimacy and longevity to customers — particularly important in Kerala's competitive retail, food, and services sectors.

5. Pan-India protection

One registration protects your mark across all 28 states and 8 UTs. No need for state-by-state registrations.

6. 10-year protection, renewable indefinitely

A trademark registration is valid for 10 years from the date of filing and can be renewed indefinitely in 10-year blocks.

What We Handle

Fast | Professional | Online

Trademark Search & Availability Check

Before filing, we conduct a thorough search of the IP India trademark registry to check if your mark — or a confusingly similar one — is already registered or pending. This prevents rejection and wasted fees.

Application Filing

We prepare and file your trademark application with the Controller General of Patents, Designs and Trademarks — correctly the first time. We handle class selection, mark description, and all supporting documentation.

Objection & Examination Response

If the Trade Marks Registry raises an objection (as it often does), we draft a detailed reply addressing each ground. A well-drafted response is critical to getting past this stage — many applications fail here due to poor handling.

Opposition Proceedings

If a third party opposes your trademark after publication in the Trade Marks Journal, we represent you in opposition proceedings before the Registrar.

Trademark Renewal

We track renewal dates and file renewal applications before your 10-year term expires, ensuring you never lose protection through oversight.

Trademark Assignment & Licensing

If you are buying, selling, or licensing a trademark, we draft the necessary assignment deeds and licence agreements and handle recordal with the Registry.

Infringement Notices & Enforcement

If someone is using your trademark without permission, we send cease and desist notices, initiate civil infringement suits, and where applicable, advise on criminal complaints.

THE REGISTRATION PROCESS

Total timeline: 2 days, the TM symbol can be used from date of filing.

Step 1 — Trademark Search

We search the IP India database to check availability and assess risk of rejection or opposition.

Step 2 — Application Preparation

We prepare the application — selecting the correct class(es), drafting the mark description, and gathering required documents.

Step 3 — Filing with IP India

The application is filed online at ipindia.gov.in. You receive an acknowledgement with an application number — your ™ symbol rights begin from this date.

Step 4 — Examination by Registry

The Trade Marks Registry examines the application and either accepts it, raises an objection, or issues an examination report.

Step 5 — Response to Objections

If an objection is raised, we file a detailed response within 30 days. A hearing may be scheduled if the examiner requires further clarification.

Step 6 — Publication in Trade Marks Journal

Once accepted, the mark is published in the official Trade Marks Journal for 4 months — during which third parties may oppose.

Step 7 — Registration Certificate

If no opposition is filed (or if opposition is successfully defended), the Registry issues the Registration Certificate. You may now use the ® symbol.
