The ™ symbol can be used immediately after filing. The ® symbol is only permitted after registration is granted — typically 18–24 months after filing.

Trademark Search & Availability Check

Step 1 — Trademark Search
We search the IP India database to check availability and assess risk of rejection or opposition.
Step 2 — Application Preparation
We prepare the application — selecting the correct class(es), drafting the mark description, and gathering required documents.
Step 3 — Filing with IP India
The application is filed online at ipindia.gov.in. You receive an acknowledgement with an application number — your ™ symbol rights begin from this date.
Step 4 — Examination by Registry
The Trade Marks Registry examines the application and either accepts it, raises an objection, or issues an examination report.
Step 5 — Response to Objections
If an objection is raised, we file a detailed response within 30 days. A hearing may be scheduled if the examiner requires further clarification.
Step 6 — Publication in Trade Marks Journal
Once accepted, the mark is published in the official Trade Marks Journal for 4 months — during which third parties may oppose.
Step 7 — Registration Certificate
If no opposition is filed (or if opposition is successfully defended), the Registry issues the Registration Certificate. You may now use the ® symbol.
